These conditions of sale are concluded on the one hand by SOROR BIJOUX, whose activity is legally declared as a Joint Venture, under the name of the SOROR BIJOUX brand, hereinafter referred to as ''the seller'', and on the other hand, by any natural or legal person, wishing to make a purchase via this site, hereinafter referred to as ''the buyer''.
1. Acceptance of Terms
The buyer acknowledges having read, at the time of placing an order, the special conditions of sale set out on this page and expressly declares to accept them without reservation.
The fact that any buyer or user places an order on this site constitutes irrevocable and unreserved acceptance of all the information presented here.
These General Conditions of Sale govern the contractual relationship between SOROR BIJOUX and its buyer, both parties accepting them without reservation.
These General Terms and Conditions of Sale shall prevail over any other conditions appearing in any other document, except prior written derogation issued by SOROR BIJOUX.
SOROR BIJOUX reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date the order is placed.
2. Products
The products offered on the site www.sororbijoux.com are unique pieces, since they are old pieces of jewelry bought second-hand, by the piece. Despite the care given to these items, some imperfections due to their age can sometimes not be avoided. They are indicated in the description of the articles. The photographs in the catalog are as faithful as possible to the condition of each item, but cannot ensure perfect similarity with the product.
SOROR BIJOUX guarantees that the origin, condition and characteristics of the product it offers on the site comply with the description given in the product sheet and that the product is not an infringing product.
The items offered on the site www.sororbijoux.com are only valid within the limits of available stocks. Product offers are valid as long as they are visible on the site. Faced with an exceptional malfunction in the management of stocks and in the event of unavailability of products after receipt of an order, SOROR BIJOUX will notify the buyer by e-mail of the delivery of a partial order or the cancellation of his order. In the event that the 'buyer's' bank account has been debited, SOROR BIJOUX will initiate an immediate refund procedure. The time will depend on the type of bank card you have: 3 to 8 days for an immediate debit, reimbursement at the end of the month for a deferred debit card.
3. Order
The automatic registration systems provided by the WIX host serve as proof of the nature, content and date of the order placed by the buyer.
SOROR BIJOUX confirms the acceptance of his order to the customer at the e-mail address that he will have communicated. The sale will only be concluded once the order has been confirmed.
SOROR BIJOUX reserves the right to cancel a customer's order, in particular in the event of a dispute relating to the payment of a previous order. The information provided by the buyer during the purchase process commits the latter. In the event of an error in the wording of the recipient's contact details, SOROR BIJOUX cannot be held responsible for the impossibility in which the company may find itself delivering the product.
4. Delivery
The delivery of items ordered on the site www.sororbijoux.com is provided by the services of the French Post Office.
The buyer has several shipping options, including or not including the cost of insurance of the actual value of the products ordered. Whatever shipping option you choose, delivery is always made with a tracking option. SOROR BIJOUX undertakes to provide the buyer with the La Poste tracking number corresponding to the dispatch of his order.
Delivery costs are the responsibility of the buyer and are expressed in euros, all taxes included.
They are offered by SOROR BIJOUX to the buyer for any order over €200.
After order confirmation, SOROR BIJOUX undertakes to deliver to its carrier all the references ordered by the buyer within a maximum period of 72 working hours. This carrier undertakes by contract with SOROR BIJOUX to deliver the order to the address provided by the buyer when ordering.
Delivery will be made in metropolitan France only, by La Poste in Colissimo with or without insurance, or by letter followed.
The goods travel at the risk and peril of the recipient and are subject to the vagaries of transport. Once the package has been delivered to the carrier, SOROR BIJOUX cannot be held responsible in the event of loss or deterioration of the items during transport.
The buyer is free to choose whether or not to use insured shipping. He is required to carefully check the contents of the package on arrival, and to ensure that no goods are missing or damaged. The buyer has 48 hours to make any reservations or complaints to La Poste in the event of damage, and to keep SOROR BIJOUX informed by e-mail (sororbijoux@gmail.com).
If the buyer is absent during the delivery of the parcel, he undertakes to collect the parcel from the post office concerned within the time allowed.
In the event that, failing to pick up the package within the time indicated, it is reshipped to SOROR BIJOUX, the buyer agrees to approach SOROR BIJOUX to organize the reshipment of the item.
The cost of returning the package will then be borne by the buyer.
5. Returns
The buyer has the legal period of 14 days to exercise his right of withdrawal from SOROR BIJOUX, by explicitly notifying SOROR BIJOUX by e-mail (sororbijoux@gmail.com) or by using the contact form on this site. www.sororbijoux.com.
Subject to respecting this deadline, the buyer is not required to provide any justification for his request.
Once the withdrawal process has been expressly confirmed by SOROR BIJOUX to the buyer by e-mail, the buyer has the legal period of 14 days to send the goods concerned to SOROR BIJOUX. Redelivery costs are the responsibility of the buyer.
Subject to having returned the goods concerned in their original condition (i.e. as they were sent by SOROR BIJOUX), and in their original packaging, the buyer will be reimbursed the total amount of his order, delivery costs included. SOROR BIJOUX retains visual proof of the original condition of the goods. In the absence of a dispute, SOROR BIJOUX undertakes to initiate the reimbursement procedure within 14 days.
6. Price
The price of the articles is expressed in euros.
The price indicated on the product sheets of the site www.sororbijoux.com does not include delivery costs. These are added at the last stage of the purchase process and are the responsibility of the buyer. They are adjusted to the current postage rates of La Poste, but also include handling, packaging and logistics costs. Delivery is free for all orders over €200.
The price indicated in the order confirmation is the final price, expressed inclusive of all taxes. This price includes the total price of the items ordered, to which are added the delivery costs mentioned above.
SOROR BIJOUX reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer.
7. Payment
The price invoiced to the buyer is the price indicated on the order confirmation sent to the buyer by e-mail by SOROR BIJOUX.
The price of the items is payable in cash on the day of the actual order.
Payment is made by credit card through the secure Stripe platform.
SOROR BIJOUX cannot be held responsible in the event of fraudulent use of the means of payment used by the buyer.
8. Disputes
This contract is subject to French law. SOROR BIJOUX cannot be held responsible for damage of any kind, whether material, immaterial or bodily, which could result from a malfunction or misuse of the products marketed.
The liability of SOROR BIJOUX will in any case be limited to the amount of the order and cannot be blamed for simple errors or omissions which may have persisted despite all the precautions taken in the presentation of the products. In case of difficulties in the application of this contract, the buyer has the possibility, before any legal action, to seek an amicable solution, in particular with the help of a professional association of the branch, an association of consumers or any other counsel of his choice. It is recalled that the search for an amicable solution does not interrupt the “short period” of the legal guarantee, nor the duration of the contractual guarantee. It is recalled that as a general rule and subject to the judgment of the Courts, compliance with the provisions of this contract relating to the contractual guarantee assumes that the buyer honors his financial commitments to the seller.
Complaints or disputes will always be received with attentive benevolence, good faith being always presumed in those who take the trouble to explain their situations. In the event of a dispute, the customer will first contact SOROR BIJOUX to obtain an amicable solution.
Otherwise, the Commercial Court of Paris has sole jurisdiction, regardless of the place of delivery and method of payment accepted.
9. Legal information
The information of personal information collected for the purposes of distance selling is mandatory, this information being essential for the processing and delivery of orders and the establishment of invoices. The lack of information leads to the non-validation of the order.
In accordance with the law "Informatique et Libertés", the processing of personal information relating to customers has been declared to the National Commission for Computing and Freedoms (CNIL). The customer has (article 34 of the law of January 6, 1978) a right to access, modify, rectify and delete data concerning him, which he can exercise with SOROR BIJOUX by e-mail: sororbijoux@gmail.com
